YOUR CONTRACT WITH US

• • These General Terms and Conditions of Sale (GTCS) apply to all services, orders and shipments of goods that you, as a customer, order from Akhal by CARAT DIAMOND, the seller, on its websites, https://akhal-jewelry.com, https://caratdiamond.ch or https://www.gemsuisse.ch. By placing an order, you acknowledge that you have read, understood and accepted these terms and conditions without reservation.
  • CARAT DIAMOND reserves the right to modify these GTC at any time by publishing a new version on the Site. Any order placed after the publication of the new version of the GCS implies acceptance of the latter.
  • Using the Website https://akhal-jewelry.com, you also agree to be bound by its Terms of Use and our Privacy Notice. Please read them carefully.

• • If you open a customer account with us, you are responsible for ensuring that the personal data you have provided is true, accurate and up-to-date before placing an order. Please ensure that the password you choose when registering remains confidential and is not divulged to anyone. 
  • We reserve the right to refuse service and/or terminate accounts without notice if they violate these Terms or if we determine that it is in the best interest of CARAT DIAMOND.

YOUR ORDER

ORDER CONFIRMATION

• • By placing an order on our Site, you agree to purchase the products you have selected in accordance with these Terms and Conditions of Sale.
  • We offer our products for sale on our website while stocks last.

PRICES AND TAXES

• • Prices are quoted in Swiss francs (CHF) and apply to the products on offer at the date you place your order. They include Swiss VAT by default.
• • Delivery charges for items ordered are payable by the customer and include postage and packaging. They are calculated individually according to the number of suppliers, weight and size of the order. Delivery costs are indicated before the order is placed.
• • CARAT DIAMOND reserves the right to modify its prices and shipping and handling charges at any time and to cancel any contract that contains errors in wording, printing or calculation.

PAYMENT

• • Payment by credit card is due immediately. Your credit card details are encrypted for security reasons.

DELIVERY

VERIFICATION OF MERCHANDISE

• • You must check the quantity and condition of the goods on delivery. In the event of breakage, delivery error or defective merchandise, you must send a written complaint by e-mail to CARAT DIAMOND within 48 hours of delivery to our Customer Service Department at the following e-mail address info@caratdiamond.ch.
• • We accept no liability for damage during transport or for damage caused by improper storage after the goods have been handed over to the transport company, to you (the customer) or to your auxiliaries.

RETURNS

• • You may return unsatisfactory goods within 5 days of receipt of the order.
• • CARAT DIAMOND only accepts returns of goods in good condition and in their original sealed packaging, accompanied by the invoice.
• • When returns have been made in the prescribed manner, CARAT DIAMOND will reimburse the price of the returned goods and the invoiced delivery costs within a maximum of 30 days from the date of receipt of the returned goods. Shipping costs are at your expense.

LIMITATION OF LIABILITY

• • The photos and texts illustrating and describing the products on this site are non-contractual and for information purposes only. CARAT DIAMOND assumes no responsibility for any errors or omissions in the photos or texts appearing on the present site.

DATA PROTECTION

• • Your personal data will be collected exclusively in compliance with legal requirements and will be processed in accordance with our Privacy Notice.

FORCE MAJEURE

• • CARAT DIAMOND will do its utmost to fulfil its obligations but cannot be held responsible for delays or non-delivery resulting from circumstances beyond its control, such as strikes, wars, natural disasters or other events that prevent the production, transport or delivery of products.
• • In the event of a delay, CARAT DIAMOND will fulfil its obligations as soon as possible and reserves the right to distribute remaining stocks of products among its customers on an equitable basis.

VALIDITY OF THE GENERAL TERMS AND CONDITIONS OF SALE

• • Should any of the provisions of these GTC be declared invalid or partially invalid, the validity and scope of the remaining provisions shall remain unaffected. Invalid conditions will be replaced by the applicable provisions of Swiss law.

APPLICABLE LAW AND JURISDICTION

• • These General Terms and Conditions of Sale are governed exclusively by Swiss law. The Vienna Convention (CISG) is excluded. The exclusive place of jurisdiction is the registered office of CARAT DIAMOND in Switzerland.
